My Crack Guru provides remote, visual-based structural assessments and diagnostic reports ("Reports") for informational purposes. Our Service includes:

  • Analysis of user-submitted photographs, videos, and descriptions of potential structural issues
  • Provision of an opinion on the potential cause and severity of the issue
  • Educational information and, for an additional fee, potential repair methods and/or referrals to local service professionals

3. Important Disclaimers & Limitations

THE SERVICE IS NOT A SUBSTITUTE FOR AN IN-PERSON INSPECTION BY A LICENSED STRUCTURAL ENGINEER OR QUALIFIED PROFESSIONAL.

  • Advisory Nature: The Report is an opinion based solely on the visual information you provide. It is for informational and educational purposes only.
  • No Engineering Guarantee: While our team consists of experienced engineers, the remote nature of the Service means we cannot guarantee the absolute accuracy of the diagnosis. Conditions in person may differ.
  • Not for Legal or Insurance Purposes: The Report is not a certified engineering report, nor is it intended for use in legal disputes, insurance claims, property transactions, or permitting processes.
  • No Liability for Actions Taken: You acknowledge and agree that My Crack Guru is not liable for any repairs, damages, losses, or injuries resulting from your reliance on the Report or any actions you take based upon it. You assume all risks associated with any DIY repairs or contracts with third-party professionals we may refer.

4. User Responsibilities

To receive the Service, you agree to:

  • Provide accurate, clear, and non-misleading photographs, videos, and descriptions of the issue
  • Provide your accurate location (city, country) to allow for geolocated risk assessment (e.g., soil type, common local issues)
  • Use the Service only for lawful purposes and not submit materials that infringe on any third-party rights

5. Fees, Payment, and Refunds

  • Fees: You agree to pay the specified fee for the Service at the time of submission.
  • Refund Policy: We offer a 100% refund if our engineers determine they cannot provide a diagnosis based on the quality or nature of the information you submitted. Once a Report has been delivered, no refunds will be granted.
  • Upsells: Any additional services (e.g., repair guides, contractor referrals) are optional and will be clearly offered at an extra cost.

6. Intellectual Property

  • Your Content: You retain ownership of the photos and videos you submit. By submitting them, you grant us a license to use them solely for the purpose of providing the Service to you.
  • Our Reports: The diagnostic Reports we generate are licensed to you for your personal, non-commercial use. You may not redistribute, resell, or modify the Reports.

7. Limitation of Liability

To the fullest extent permitted by law, My Crack Guru, its employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from your use of the Service.

8. Governing Law

These Terms shall be governed by the laws of New South Wales, Australia, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this site. Your continued use of the Service after any change constitutes your acceptance of the new Terms.

11. International Use & Governing Law

By using our Service from outside Australia, you understand and agree that you are importing a digital service from Australia, and that the provision of this Service is subject to Australian law as outlined herein.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts located in New South Wales, Australia for the resolution of any dispute or claim arising from these Terms.
